Privacy Policy

MCY Site Services, LLC, doing business as DumpsterLogix ("DumpsterLogix," "we," "us," or "our"), operates www.dumpsterlogix.com (the "Site") and the DumpsterLogix software platform (the "Platform"), a business management system for roll-off dumpster rental companies. This Privacy Policy explains what information we collect, how we use it, how we protect it, and your rights regarding your personal information.

OUR TWO ROLES

DumpsterLogix handles personal information in two distinct capacities:

1. When we act for ourselves (data controller). This applies to visitors to our Site, prospects who request a demo or quote, and the businesses and their staff who subscribe to and use the Platform (our "Customers"). For this information, this Privacy Policy governs directly.

2. When we act on behalf of our Customers (data processor). Dumpster rental companies use the Platform to manage their own clients — including names, addresses, phone numbers, order history, and payment records of the people renting dumpsters from them ("End-Customer Data"). We process End-Customer Data solely on the instructions of the Customer who entered it. That Customer — your dumpster rental provider — is responsible for that data and for its own privacy practices. If you are an end customer of a business that uses DumpsterLogix and want to access, correct, or delete your information, contact that business directly. We will assist them in fulfilling your request.

WHAT INFORMATION IS COLLECTED

Account and Contact Information: Full name, email address, business name, business mailing address, and mobile phone number of Customers and their authorized users.

Business Verification Information: When a Customer enrolls in text messaging through the Platform, we collect business registration details required by U.S. carrier compliance programs (A2P 10DLC), which may include the business's legal name, address, and federal Employer Identification Number (EIN). EINs are transmitted directly to our telecommunications provider (Twilio) for carrier registration and are not stored in DumpsterLogix systems.

Payment Information: Subscription billing and payment processing are handled by Stripe. Customers who accept payments from their own clients through the Platform do so via their own Stripe accounts. We do not store full credit card numbers or bank account credentials; we retain only tokens, transaction records, and payment status information provided by Stripe.

Platform Data: Information Customers enter or generate while using the Platform, including client records, orders, dispatch schedules, inventory, invoices, and reports. Where this includes End-Customer Data, we process it as described in "Our Two Roles" above.

Communication Records: Records of emails, text messages (SMS), phone calls, support requests, and contact or demo form submissions.

Technical Information: IP address, browser type, device information, log data, and pages visited on our Site and Platform (via cookies and analytics tools).

SMS Consent Records: When a user opts in to SMS messaging, we log the consent along with a timestamp and, where available, IP address.

HOW DATA IS USED

We use the information we collect for the following purposes:

We do not sell personal information, and we do not use Customer or End-Customer Data to train third-party artificial intelligence models.

SMS MESSAGING

DumpsterLogix collects mobile phone numbers to send transactional SMS messages related to Platform accounts and service inquiries. In addition, our Customers use the Platform to send their own transactional SMS messages (such as delivery and pickup notifications) to their end customers; consent for those messages is collected and managed by the Customer as the sender.

Consent to receive SMS is not a condition of purchase. Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for assistance at any time.

For full details, see our SMS Policy at https://www.dumpsterlogix.com/sms-policy.

NO MOBILE INFORMATION SHARING

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties, excluding aggregators and providers of the text message services.

This no-sharing policy applies specifically to:

Mobile opt-in data is used solely for the purpose of providing service-related SMS communications to the person who provided consent.

HOW INFORMATION IS USED WITH SERVICE PROVIDERS

We use trusted service providers, and only as needed to operate our business, to perform specific functions:

These service providers act on our behalf to perform specific functions and are bound by contractual obligations to protect your information. We do not authorize them to use your information for their own purposes.

All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties, excluding aggregators and providers of the text message services.

We may disclose your information if legally required, such as in response to a court order, subpoena, or government investigation, or if necessary to protect our legal rights or the safety of others.

COOKIE AND TRACKING INFORMATION

Our Site and Platform use cookies and similar technologies to:

You may disable cookies through your browser settings, though some features (such as signing in to the Platform) may not function properly without them. We do not use third-party advertising cookies.

DATA SECURITY PRACTICES

We use reasonable administrative, technical, and physical safeguards to protect personal information, including:

No method of electronic transmission or storage is 100% secure. While we strive to protect your information, we cannot guarantee absolute security.

USER RIGHTS

Depending on your state of residence (including rights under the Texas Data Privacy and Security Act), you may have the following rights regarding your personal information:

We do not sell your personal information. You can request written confirmation of this.

If you are an end customer of a business that uses DumpsterLogix, direct your request to that business; we will support them in fulfilling it.

To exercise any of these rights, contact us at info@dumpsterlogix.com or call 832-220-1518.

DATA RETENTION

We retain personal information for as long as necessary to provide services, comply with legal obligations (including tax and accounting records, typically 7 years), resolve disputes, and enforce agreements. SMS opt-in consent records are retained for the duration of the opt-in and at least 4 years thereafter. When a Customer closes their account, we delete or de-identify Platform Data within a commercially reasonable period, subject to legal retention requirements and backup cycles.

CHILDREN'S PRIVACY

Our services are directed to businesses and are not directed to children under 13. We do not knowingly collect personal information from children under 13. If we become aware that we have collected such information, we will delete it promptly. Our SMS program is intended for users aged 18 or older.

CHANGES TO THIS PRIVACY POLICY

We may update this Privacy Policy from time to time. The "Last Updated" date at the top reflects the most recent revision. Continued use of our Site and services after any changes constitutes acceptance of the updated Privacy Policy.
